These terms of service are entered into by and between You and The Intern ("Company", "we", or "us"). The following terms and conditions ("Terms of Service") govern your access to and use of theintern.ai, including any content, functionality, and services offered on or through our platform.

By using the Website, you accept and agree to be bound and abide by these Terms of Service. If you do not want to agree to these Terms of Service, you must not access or use the Website.

2. Autonomous Agent Services

The Intern provides autonomous AI business agents capable of executing tasks across various domains including, but not limited to, sales, marketing, operations, and support (the "Services").

User Responsibility for AI Output: Due to the probabilistic nature of Large Language Models (LLMs), output generated by the AI agents may occasionally be inaccurate, incomplete, or inappropriate. You are solely responsible for reviewing and verifying the output of the agents before relying on it for business decisions or exposing it to your customers.

3. Prohibited Uses

You may use the Website only for lawful purposes and in accordance with these Terms of Service. You agree not to use the Website:

  • In any way that violates any applicable federal, state, local, or international law or regulation.
  • For the purpose of exploiting, harming, or attempting to exploit or harm minors in any way.
  • To generate or disseminate spam, unauthorized advertising, or fraudulent materials.
  • To impersonate or attempt to impersonate the Company, a Company employee, another user, or any other person or entity.
  • To deploy autonomous agents with the intent to scrape, disrupt, or attack external systems or APIs.

4. Subscriptions and Payments

Certain aspects of the Services are provided for a fee or other charge. If you elect to use paid aspects of the Services, you agree to the pricing and payment terms as we may update them from time to time.

API Key Usage (BYOK): If utilizing the "Bring Your Own Key" (BYOK) architecture for LLM providers (e.g., Anthropic, OpenAI, ElevenLabs), you are solely responsible for the costs incurred directly with those providers. The Intern is not liable for API overages resulting from agent execution loops.

5. Disclaimer of Warranties & Limitation of Liability

THE PLATFORM AND THE AUTONOMOUS AGENT SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

IN NO EVENT WILL THE COMPANY, ITS AFFILIATES, OR THEIR LICENSORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE, OR INABILITY TO USE, THE PLATFORM, INCLUDING DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING REVENUE OR PROFIT LOSS DUE TO AGENT ACTIONS).
